My Experience in trying to get action from our Mgmt. Co. and Corp.board & OneBoard Re: Fire Lane Parking Violations and much more. I even tried emailing Two.Board and also got no reply.



In A Nutshell:
1. No response from board for
over 4 months.

2. Lied to by Mgmt. Co. as to actions taken to resolve (said they made call & sent letters that Board Member refused to confirm it's occurrence) relative to Fire Lane violations. Surly he would know. Right? Nor, did the violations stop.

3. Ok to park in fire lanes for up to 2 hours, but don't tell anyone. Board Member states in email.

4. In One email I was told to call the Patrol Company, but given no info. on who they were, so I checked the website, and the signs at front and rear entrances and NOTHING. Finally got Mgmt. Co. to put Info. on website, with no instructions as to why or when homeowners should contact them.
Apparently their philosophy is to keep the homeowners in the dark as much as possible so as to limit their need to enforce the rules.

I called Patrol Masters and they said that there was nothing they could do unless the cars were still there when they patrol at 11pm nightly.
Misdirection by Mgmt. Co.

4. At one point about 2 months in I called the HBPD. They sent a parking patrol car out, who did nothing. I called the watch commander
Lt. Martin who insisted they could not ticket because our Fire Lane Markings DO NOT MEET THE Fire Dept. Code.  I looked up that Fire Dept. Code online and saw clearly that we do not meet the code. I reported all this to Mgmt. Co. and Board Of Directors several times and never got any response, but of course the Board member above insisted that the HBPD would ticket and that our fire lanes met the code, never providing any proof of same.

5. Same results when I informed them that our signs at front entrance did not match those at back entrance. I was told that would be addressed and fixed.
Never anything done to fix them.


6. Many of my Questions where ignored and never answered. A: Patrol Masters duties on website do not indicate that they have any parking duties, so why would we call them? Reported - No Response.  B: When does the summer weekend live guard start and end? NO Response.  C: Legal Liability. No Response. See emails and below.





Conclusion:  
1. Board & Mgmt. Co. INCOMPETENT, DISHONEST, UNACCOUNTABLE, AND NONRESPONSIVE.

2. Board member in charge of parking enforcement said in his email (also see last email link below) that took four months to extract from him or anyone else that
"We do not toe cars that are parked for only 2 hours, you need to call the police." "Really nothing wrong with parking there for short periods...2 hours."

Although I had, over a period of 4 months, reported 15-20 violations lasting well over 3-6 hours in duration, in our telecom he stated
"But Don't Tell anyone or they will all start doing it."

3. Just consider the Legal Liability, if a child darting from behind a car parked illegally in the fire lane gets injured, or killed, or if the fire dept. can't access a home to extinguish a fire. DO YOU WANT THAT LIABILITY?  Just because our Mgmt. Co. and Board apparently doesn't think it's important to enforce the rules.

4. One last thing:  Has the board ever considered that a homeowner when selling a property is  required to disclose all negative aspects relating to the property of sale, and that by law they  should disclose that their Association refused to enforce the Fire Lane parking rules as they  appear in the CC&R, or change the rules if they are not valid enough so that the local PD would  enforce them, thereby giving the buyers the opportunity of knowing the truth before  consummating the purchase????? You better check with your attorney on this, as I sold R.E.  here in Orange County for over 7 years and not informing a buyer of this would constitute a  cause for Law Suite, not only against the seller but also the Association.

Question: Would it save a homeowner a lot of time and grief if they simply told the truth, or they actually enforced our rules, and if not eliminate them?  Do you like being lied to by omission?

I don't, and I would have appreciated the truth early on, and will take all this into consideration at the next board elections.
